I was told I or who ever owns this property would never be eligible for another buyout again for turning down the last one.

A.) Priority #1: Substantially damaged properties
Priority #2: Properties whose owners are participating in the Dyersville New-Production Program
Priority #3: Properties that are currently vacant
Priority #4: Properties that are owner-occupied primary residents
Priority #5: Properties that are tenant-occupied or secondary homes
A.) Acquisitions will take probably 6 - 12 months.
Demolition will take probably 3 - 6 months after the acquisitions are completed.
The City has 36 months to complete the entire project.
A.) Additional properties cannot be added to the program. However if additional funding sources become available the City will look into pursuing additional funds. The properties would have to meet the program guidelines.
A.) Closing costs are paid by the City with either HMGP or CDBG acquisition grant funds.
However if a seller (property owner) is unable to deliver an existing abstract to the City, the costs of creating a new 40-year abstract shall be paid by the Seller.
The Seller shall pay all costs required to perfect its title to the Property and shall pay the costs of any additional abstracting and/or title work due to acts or omissions of Seller, including transfers or death of Seller or assigns. The abstract shall become the property of the City when the Purchase Price is paid in full.
A.) The answer in short is no. Since the program is funded with federal funds there are strict rules and regulations that must be followed.
However, you may choose to bid on the demolition. If interested please provide your contact information to Nicole Turpin and a bid packet will be sent to you when the project gets to that step.
A.) The seller (property owner) shall pay all of the taxes on the property (real and personal) up to the date of closing. If any such taxes cannot be determined by the date of the closing, such taxes shall be based on the amount of the last determinable installment, proportionately adjusted by any change on the assessed valuation attributable to capital improvements and which are determinable on the date of closing. The Seller agrees and acknowledges that Seller shall be responsible for the entire amount of the real estate taxes for the current fiscal year, payable in the next fiscal year.

A.) The City will make a Replacement Housing Benefit Payment based on the owner-occupants purchasing replacement housing which is decent, safe, and sanitary, located outside the floodplain, within 6 months from the owner-occupant's acceptance of the City's offer to purchase the flood damaged property. The payment amount of the Replacement Housing Benefit cannot exceed $10,000. The replacement housing purchase price must be at least $10,000 higher than the purchase offer on the buyout property to receive the full $10,000 benefit. If the replacement housing purchase price is $1,000 more than the purchase offer on the buyout property then the replacement housing benefit would be $1,000.

A.) The HMGP acquisition application was submitted to Iowa Homeland Security and Emergency Management (IHSEM) January 30, 2009. IHSEM reviewed the applicant and it went to FEMA for review and approval. At this time we were being told that awards would be made by March or April. The City told property owners April or May to provide some additional time in case of delays. FEMA is the agency that decided which properties would be included on the application. In the mean time the Iowa Department of Economic Development (IDED) decided to see if some of the CDBG disaster funds coming into the State could be used for acquisitions. The Department of Housing and Urban Development (HUD) agreed, which is the federal agency that administers the CDBG funds. CDBG applications were due July 1, 2009, at which time The City was still waiting on word regarding the HMGP application. All 37 properties were included on the CDBG application in case the application was not funded or in the event FEMA removed some properties. IDED is working through the applications and will hopefully be making an award announcement shortly. They have not provided a more detailed timeframe. Once the City is notified of the award all property owners on the CDBG application will be notified as well as the Citys flood buyout questions website.
A.) The City of Dyersville has been awarded the funding to acquire and demolish all 27 properties on the HMGP application. This is a voluntary program and the property owners can choose to not participate in the program. .
A.) The funding for this program under the both the HMGP and CDBG programs are voluntary acquisitions.
If a property owner chooses to decline the voluntary buyout program that in itself does not eliminate that property from being included in a future buyout.
Please beware that there may not be another buyout round. Typically these grant funds are only made available after a disaster. The City would have to choose to apply and would also have to choose to include said property in the application. The disasters of 2008 have provided significant amounts of funding for mitigation/acquisition that may or may not be seen in the future. For example CDBG funds have been used to cover the 15% local match that typically a community has to cover. Previous Dyersville Acquisition projects have required the property owner to provide the 15% local match requirement. CDBG have also been used to provide 100% acquisitions for properties that did not have a strong enough benefit cost analysis (BCA) to be included in the HMGP program. This is the first time that CDBG funds have been used to acquire disaster affect properties.
